Whereas, in the Constitution of the United States the right of individuals to keep and bear arms is reserved to the people;

Whereas, in the Constitution of the State of             , the right of individuals to keep and bear arms is reserved to the people;

Whereas, the primary effect of the rights the people have reserved to themselves is to prevent government interference with exercise of those rights and to restrain government actors;

Whereas, the Sheriff has taken a solemn oath to uphold and defend the U.S. and (state)   constitutions;

Whereas, pursuant to that solemn oath, the Sheriff has a duty to preserve and protect the rights of the people of the county to keep and bear arms; and

Whereas, the Sheriff has no choice under his oath except to execute his duty to the people of the county, especially including to protect their right to keep and bear arms.

Therefore, the following policy is adopted for the          County Sheriff's Office and applies to all employees of any level of government operating within the boundaries of the county:

1.  No person may be deprived of legally owned firearms or ammunition as guaranteed by
the Second Amendment and by this policy;

2.  No employee of the State of          or of the United States may deprive any person in          County of any firearm, firearms or ammunition without the advance, written permission of the Sheriff or his proper delegate;

3.  No employee of the State of          or of the United States may arrest any person in          County for any offense related to possession or use of firearms or ammunition without the advance, written permission of the Sheriff or his proper delegate;

4.  Any person in violation of this policy may be subject to arrest and prosecution for theft, for armed robbery if the person is armed during the event, for extortion or illegal threats if any threat, threat of force or coercion is used during the event, for assault if any force is used during the event, or for kidnapping or illegal restraint.
